Justicia transicional: conceptos clave y aspectos normativos

This paper is an exposition about the key concepts of transitional justice. We will introduce briefly its four basic measures (penal responsibility, truth seeking, victim reparations and nonrepetition guarantees). After that, we will analyse some of the normative aspects and dilemmas that these measures involve. These questions include: opposite exigencies (for example, between truth and justice); problems related with the application of universal abstract norms to particular contexts; the complex balance between truth, memory and reconciliation; a disquisition about the concept of victim and the concept of perpetrator; and a reflection concerning the future of transitional justice.

After almost 20 years of political instability and ongoing conflicts in the Western Balkans, the region is still haunted by the past, and there is an ongoing synergy of influence between media and the political sector. Media in this region have frequently been criticized for fueling conflicts, instigating ethnic hatred and taking political sides. This article suggests a new research agenda in the practice of transitional journalism in this part of Southeastern Europe. Abstract∞ This article provides new insight into how the ‘found grandchildren’ of postconflict Argentina are reconstructing their sense of self and identity after having been identified as children of disappeared political activists in the aftermath of the last military regime (1976–1983). We offer tools for understanding how they respond to the context-specific transitional justice measures of identification and restitution, and how this plays out on social media.
